Terms and Conditions

These terms govern your use of this website and the basis on which Commercial Switchboards provides services. Please read them carefully. By accessing this website or engaging our services, you agree to these terms.

1. About these terms

This website (commercialswitchboards.com.au) is operated by SEQ Sparky Pty Ltd (ABN 72 666 569 820), trading as Commercial Switchboards (“Commercial Switchboards”, “we”, “us” or “our”). Commercial Switchboards is the specialist commercial and industrial switchboard division of SEQ Sparky Pty Ltd.

In these terms, “you” means any person who accesses this website or engages our services, and “services” means the commercial and industrial switchboard and electrical services we provide.

2. Acceptance and changes

By accessing this website, requesting an initial project review, or engaging us for any work, you agree to be bound by these terms. If you do not agree, please do not use this website or our services.

We may update these terms at any time by posting the revised version on this website. The version in force is the one published here at the time you access the site or engage us. Material changes will be reflected in the “last updated” date above.

3. Who we work for

Commercial Switchboards delivers commercial and industrial switchboard and electrical work only. We do not undertake residential switchboard upgrades, single power point work, or general domestic light-and-power jobs. Enquiries for residential work are best directed to a general electrical contractor, including our sister brand SEQ Sparky.

4. Use of the website

Content on this website is provided for general information about our services across commercial, industrial and related sectors. While we make reasonable efforts to keep information accurate and current, we do not warrant that it is complete, error-free, up to date, or fit for any particular purpose. Information on this website does not constitute electrical, engineering, legal or professional advice, and should not be relied on in place of a site-specific assessment.

You agree not to use this website:

  • in any way that breaches any applicable law or regulation;
  • to transmit any harmful code, or to interfere with the operation, security or availability of the website;
  • to copy, scrape, harvest or republish content except as permitted in clause 9; or
  • in any way that could damage, disable or impair the website or its underlying systems.

5. Indicative pricing and engagement

Any indicative pricing, figures, ranges or estimates provided through this website, by email, or in conversation are general in nature, based only on the information available at the time, and do not constitute an offer capable of acceptance.

Every commercial switchboard project begins with an initial project review. Detailed scope, firm pricing, programme and conditions are confirmed in a written project agreement (which may take the form of a proposal, scope of works, or contract) issued for the specific project. No binding commitment exists until that written project agreement is accepted by both parties.

Where there is any inconsistency between this website and a written project agreement for a specific project, the written project agreement prevails for that project.

6. Project delivery and standards

All electrical work is carried out under QLD Electrical Contractor’s Licence #90899 and in accordance with AS/NZS 3000 (the Wiring Rules), AS/NZS 61439 (low voltage switchgear and controlgear assemblies), AS/NZS 2067 where high voltage work is involved, and applicable Energex, Ergon and supply authority requirements.

Where engineering certification is required, it is coordinated with an RPEQ-registered electrical engineer. The specific obligations, standards, inclusions, exclusions and acceptance criteria for any project are governed by the written project agreement for that project.

7. Site access, information and client responsibilities

To allow us to deliver a project safely and on programme, you agree to:

  • provide safe, timely and adequate access to the site and the relevant switchboards and electrical infrastructure;
  • provide accurate and complete information, including drawings, defect notices, asset records, load details and known hazards, so far as you are aware of them;
  • disclose any known asbestos, hazardous materials, confined space, working-at-height or other site hazards;
  • coordinate tenant, resident, occupant and operational requirements where access or shutdowns affect them; and
  • obtain any internal, owner, body corporate, landlord or tenant approvals required for the work to proceed.

We are not responsible for delays, additional costs or consequences arising from inaccurate or incomplete information provided to us, or from access, approvals or site conditions outside our control.

8. Variations

Any change to the agreed scope, including changes arising from unforeseen site conditions, latent defects, hazardous material discovery, supply authority requirements or client requests, is treated as a variation. Variations are documented, costed and agreed in writing before the additional work proceeds, except where immediate action is required to make a site safe.

9. Intellectual property

All content, text, branding, logos, photographs, images, layouts and design on this website are owned by Commercial Switchboards or SEQ Sparky Pty Ltd, or are used under licence. The “Commercial Switchboards” name, logo and associated branding are our property.

You may view and print pages of this website for your own internal, non-commercial reference. You may not otherwise copy, reproduce, republish, distribute, modify, frame or commercially exploit any content from this website without our prior written consent.

Where we deliver a project, ownership of project documentation (such as drawings, certificates and reports) is dealt with in the written project agreement for that project.

10. Photographs and project records

We may photograph our work, including switchboards, installations and site conditions, for compliance, documentation, marketing and portfolio purposes. We take care not to disclose confidential commercial information or identify individuals, and we do not publish material that would breach a site’s security or a client’s confidentiality. If you do not want a project featured in our marketing, let us know in writing and we will respect that request.

11. Third-party links and references

This website may reference third parties, manufacturers (such as Schneider, NHP and IPD), supply authorities (such as Energex and Ergon) or other organisations. References to manufacturers, standards or authorities are for information only and do not imply endorsement, partnership or affiliation unless expressly stated. We are not responsible for the content, products or services of any third party.

12. Warranties and guarantees

Workmanship on completed projects is backed by the workmanship guarantee set out in the relevant written project agreement.

Equipment and switchgear warranties pass through from the original manufacturer (such as Schneider, NHP, IPD or the selected switchboard builder) on the manufacturer’s published terms. We do not extend, vary or assume manufacturer warranties.

Any guarantee or warranty we provide is in addition to, and does not exclude, any rights or remedies you have under the Australian Consumer Law.

13. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that applies under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Where we are permitted by law to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having the relevant services resupplied.

14. Limitation of liability

To the maximum extent permitted by law, and subject to clause 13:

  • we exclude all liability for any indirect, incidental, special or consequential loss, and for any loss of profit, revenue, production, contracts, goodwill or anticipated savings, arising from your use of this website or our services;
  • we are not liable for any loss or damage arising from your reliance on general information published on this website rather than on a site-specific assessment or written project agreement;
  • we are not liable for any loss arising from circumstances beyond our reasonable control; and
  • our total aggregate liability arising out of or in connection with a project is limited as set out in the written project agreement for that project.

15. Indemnity

You agree to indemnify us against any liability, loss, damage, cost or expense we suffer arising from your breach of these terms, your provision of inaccurate or incomplete information, or your failure to meet your responsibilities under clause 7, except to the extent caused by our own negligence or breach.

16. Confidentiality

Each party agrees to keep confidential any non-public commercial, technical or site information disclosed by the other in connection with a project, and to use it only for the purpose of that project, except where disclosure is required by law or to a professional adviser, supplier or authority for the purpose of delivering the work.

17. Privacy

Personal information collected through this website or in the course of providing services is handled in accordance with our Privacy Policy, available at https://commercialswitchboards.com.au/privacy-policy/. By using this website or engaging us, you consent to that handling of your information.

18. Force majeure

We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including supply authority delays, manufacturer or material lead times, severe weather, natural disasters, industrial action, pandemics, or acts of government.

19. Termination and cancellation

Either party may end an engagement in accordance with the written project agreement for that project. Where work has been performed or materials or switchboards have been ordered or manufactured prior to cancellation, you remain liable for that work, those materials and any committed costs as set out in the written project agreement.

20. General

These terms, together with the written project agreement for any specific project, form the entire agreement between us in relation to that subject matter and supersede any prior representations.

If any provision of these terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.

A failure or delay by us to exercise a right under these terms is not a waiver of that right.

You may not assign or transfer your rights under these terms without our prior written consent.

21. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
